PROJECT HERCULES: WEBSITE RULES

  • GENERAL
    1. Rules) controlling the use of the website (Website) made available to approved Viewers (as defined in clause 1.2) in relation to the development by Duchenne UK (Duchenne) and various other parties of various evidence-based tools and a core economic model for use in the appraisal of new treatments for Duchenne Muscular Dystrophy (Project). 
    2. Viewers) to access, via the internet, information relating to the Project (Information). By accessing or using the Website, the Viewer agrees to be bound by these Rules. These Rules apply to each and every occasion on which the Website is accessed by a Viewer. 
  • USING THE WEBSITE
    1.  
      1. take all reasonable steps to ensure that none of the Information is visible to, or capable of being overlooked by, other persons;
      2. not leave their computer or other communications device through which they access the service unattended whilst connected to the Website;
      3. ensure that they close the browser and log out when they have finished using the Website;
      4. not deface, mark, alter, modify, vary (including varying the sequence of) damage or destroy in any way any Information contained on the Website;
      5. not attempt to disable the protection software associated with the Website; and
      6. keep their Website password confidential and not share their Website password with anyone else.
  • NO WARRANTY
    1. No representation or warranty, express or implied, is made or given as to the adequacy, accuracy, reliability or completeness of the Information or as to the reasonableness of any assumptions on which any of it is based. Viewers agree, on their own behalf and on behalf of any person to whom they make known any part of the Information (subject to the provisions of clause 4), that Duchenne has no liability to Viewers or any person to whom information is made available resulting from the use of the Information. In making the Information available, Duchenne is under no obligation to provide any additional information or to update or correct any inaccuracies which may become apparent in any of the Information.

  • CONFIDENTIALITY
    1. Viewers shall:
      1. not disclose to any person any Information except as permitted by clause 4.2;
      2. maintain the Information in confidence; and
      3. Purpose). 
    2. Viewers may disclose the Information:
      1. to its officers, employees, agents, subcontractors, representatives or advisers who need to know such information only for the Purpose, provided that such persons are subject to equivalent obligations of confidentiality and the Viewer shall ensure such persons comply with those obligations; and 
      2. as may be required by applicable law, court order or any governmental or regulatory authority.
